Terms of Service

Effective Date: February 2026

Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Dazzling Works LLC ("Dazzling Works," "we," "us," or "our") governing your use of the Restore Colorize Upsize Photos mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Service Description

The App uses artificial intelligence to restore old, damaged, or low-quality photographs. Users upload photos to our servers for AI processing, and restored versions are returned to the user.

Subscription Plans & Pricing

Free Tier

  • 3 free credits to try the App
  • No subscription or payment required
  • One-time use per device (a new device receives new free credits)
  • Free credits cannot be rolled over

Basic Plan

  • Monthly: 100 credits per month
  • Yearly: 100 credits per month (discounted annual rate)
  • Credit Rollover: Up to 25% of your monthly allowance (25 credits) can roll over to the next billing period

Super Plan

  • Monthly: 500 credits per month
  • Yearly: 500 credits per month (discounted annual rate)
  • Credit Rollover: Up to 50% of your monthly allowance (250 credits) can roll over to the next billing period

Credit System

How Credits Work

  • 1 credit = 1 standard photo restoration
  • Some advanced restoration modes may cost 2-3 credits (clearly displayed before use)
  • Credit costs are shown before you confirm each restoration

Credit Rollover Rules

  • Unused credits accumulate monthly up to the rollover limit for your plan
  • Basic Plan: Maximum 25 credits can roll over (25% of 100)
  • Super Plan: Maximum 250 credits can roll over (50% of 500)
  • Rollover credits are used first before your new monthly allocation

Important Credit Policies

  • Credits are non-transferable between devices
  • Credits are non-refundable
  • All unused credits EXPIRE immediately when your subscription ends or is canceled
  • Rollover credits are lost if your subscription lapses for any reason
  • Free trial credits cannot be rolled over
  • Downgrading from Super to Basic: any credits exceeding the Basic plan allowance are forfeited

Subscription Terms

Billing & Renewal

  • Payment is charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • Renewal price equals the current subscription price at time of renewal

How to Cancel

To manage or cancel your subscription:

  1. Open the Settings app on your iOS device
  2. Tap your name at the top
  3. Tap Subscriptions
  4. Select Restore Colorize Upsize Photos
  5. Tap Cancel Subscription

Cancellation takes effect at the end of your current billing period. You retain access until then.

Refund Policy

  • No refunds for partial subscription periods
  • Refund requests must be directed to Apple through the App Store
  • We cannot process refunds directly as payments are handled by Apple

Photo Processing

  • Photos you upload are sent to our servers for AI processing
  • We do NOT view, access, or use your photos for any purpose other than completing your requested restoration
  • Photos are automatically deleted from our servers after 90 days
  • Processing times vary based on server load (typically seconds to a few minutes)
  • No guarantee of specific results — AI restoration quality varies depending on the source image condition, resolution, and damage type
  • Always keep your original photos — we are not responsible for lost or corrupted files

Acceptable Use

You agree NOT to:

  • Upload illegal content or content that violates any applicable laws
  • Upload content you do not have the rights to use
  • Attempt to abuse, exploit, or circumvent the credit system
  • Reverse engineer, decompile, or attempt to extract the source code of the App
  • Use the App for any commercial purpose without our written consent
  • Interfere with or disrupt the integrity or performance of the App or its servers
  • Attempt to gain unauthorized access to the App or its related systems

We reserve the right to terminate or suspend access to the App for users who violate these terms.

Intellectual Property

  • The App, including its design, features, and content, is owned by Dazzling Works LLC
  • You retain all rights to the photos you upload and the restored versions you receive
  • We do not claim any ownership or license to your photos

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or that defects will be corrected. We make no guarantees regarding the quality, accuracy, or results of any photo restoration.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAZZLING WORKS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN SUBSCRIPTION FEES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Termination

  • We may terminate or suspend your access to the App at any time for violations of these Terms
  • You may cancel your subscription at any time through iOS Settings
  • Upon termination, all unused credits are forfeited immediately
  • Sections regarding Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Governing Law survive termination

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Updating the "Effective Date" at the top of this page
  • Including notice in app update notes for significant changes

Your continued use of the App after any changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in California.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
